Under the Licensing Act 2003 a 'relevant representation' may be made in opposition to, or in support of, a licensing application, and can be made by any individual, body or business, irrespective of their place of residence or location.
How to make a relevant representation
The type of applications that members of the public are permitted to comment on are as follows:
- application for a new Premises Licence or Club Premises Certificate (28 days)
- application to make a variation of an existing Premises Licence or Club Premises Certificate (28 days)
- application to make a minor variation of an existing Premises Licence or Club Premises Certificate (10 working days)
The numbers that appear in brackets indicate the duration of the consultation period in respect of each type of application.
In addition, this Licensing Authority, as well as, Responsible Authorities (RAs), which include Derbyshire Police, Derbyshire Fire and Rescue Service and other statutory bodies also have the ability to make a representation in respect of each type of application listed above.
Relevant representations
For a representation to be considered relevant, and therefore accepted by this authority, it must meet the following criteria, as set out by the Licensing Act 2003:
- relate to one or more of the four licensing objectives
- be submitted in writing within the consultation period
- not be frivolous, repetitive or vexatious in nature
The four licensing objectives are:
- prevention of crime and disorder
- prevention of public nuisance
- public safety
- protection of children from harm
Frivolous and vexatious representations
A frivolous representation would be categorised by a lack of seriousness.
A representation may be considered to be vexatious if it appears to be intended to cause aggravation or annoyance, whether to a competitor or other person, without reasonable cause or justification.
